As the manager walked away, Hernandez "sucker punched" him on the side of the head, rupturing his eardrum. The police responded at 1:17 a.m. Hernandez called Coach Urban Meyer, and Meyer called Huntley Johnson, the team's unofficial defense lawyer. The victim later told police that he had been contacted by lawyers and the team and that a settlement was being worked out, something the team denied. The police department recommended charging Hernandez with a felony battery, but the incident was settled out of court with a deferred prosecution agreement.
