In April 2011, Intercontinental Exchange (ICE), an American futures exchange, and NASDAQ OMX Group had together made an unsolicited proposal to buy NYSE Euronext for approximately US$11,000,000,000, a deal in which NASDAQ would have taken control of the stock exchanges. NYSE Euronext rejected this offer twice, but it was finally terminated after the United States Department of Justice indicated their intention to block the deal due to antitrust concerns.

A high school friend had been pulled over earlier in the evening after driving Hernandez home from a Boston bar. The driver was weaving in and out of lanes and traveling at 120 miles per hour in a work zone and on a highway with a speed limit of 55 miles per hour. The Massachusetts State Trooper who pulled the car over did not arrest the driver because he recognized Hernandez in the passenger seat. The Plainville police also recognized Hernandez, and told the two to go indoors.
