The Court, in their ruling, also officially ended the practice of abatement ab initio, ruling that it was outdated, never made sense, and that it was "no longer consonant with the circumstances of contemporary life, if, in fact, it ever was." After the ruling, Hernandez's estate vowed to appeal the ruling further.
